Customer Privacy
Customer account details, usage statistics, logs, payment data and other sensitive information is never shared or sold to any individual, agency or organization (with the exception of illegal use of our services, which will be reported to relevant law enforcement agencies immediately).
General Usage / Prohibited Content
Services provided by GoWest Hosting and its affiliates may only be used for lawful purposes, to provide general-audience (non-adult) content.
Transmission, storage or displaying any information, data or other material in violation of any United
States Federal, State, County or City law is strictly prohibited.
This
includes, but is not limited to:
Copyrighted materials,
MP3 files, or software
Hacking-related sites or software
Sites supporting or related to UCE/spam
Excessive file distribution / site mirroring
Fraudulent ecommerce or financial transactions
Pornography or other adult related material
Sexually related materials, products or services
Links to any above materials
Unsolicited Email
GoWest Hosting maintains a zero-tolerance policy for spam or other unsolicited email sent from our mail servers. Unsolicited email is the sending of email without prior consent or permission from the recipient. This includes but is not limited to:
Using fictitious 'from' email addresses
Broadcasting to unsolicited groups or mailing lists
Email messages referencing sites hosted on our servers
Usage of purchased email address databases
Opt-out email distribution
Opt-out email implies that the user has the option to 'unsubscribe' but did not intentionally subscribe to the list. This is strictly forbidden and will be seen as an intentional violation of this policy, subject to all applicable fines and account termination.
In addition, any true and valid opt-in mailing list (where the user has intentionally and individually requested receipt of email from a specific sender) must also contain a link or other visible method for removal of the recipient address from any and all future email distribution from the sender, or affiliates of the sender.
GoWest Hosting reserves the right to impose fees up to $1000 for each violation of this policy.
Copyright Violations
All GoWest Hosting customers are required to respect the legal protection provided by copyright and license to all files and data. If you believe that any copyrighted materials have been copied, adapted, reproduced, or exhibited in a way that constitutes copyright infringement, please provide written notice, in accordance with the requirements of the Digital Millenium Copyright Act.
Excessive Resource Usage
Dynamic scripts and applications may require excessive usage of system resources and/or bandwidth, negatively affecting service and performance of other hosted sites. The account holder assumes full responsibility for all scripts and other content, regardless of original source or author. GoWest Hosting will attempt to provide reasonable warning and assistance where available, however, any resource-draining scripts or other sources of excessive use are subject to immediate suspension and/or termination without prior notice, pending resolution or removal of the offending script.
Financial Transactions
GoWest Hosting actively supports and encourages the online exchange of goods, services and currency (e-commerce). However, all financial transactions and other exchanges taking place via hosted websites, as well as any related guarantees, warranties, representations, terms and delivery of said transactions or their intended products, are solely a function of the customer's online activity and in no way associated with GoWest Hosting or its affiliates. As the network provider, GoWest Hosting makes no claim regarding qualifications or results in respect to any third-party purchasers or recipients of goods or services provided by our hosting customers.
Payment of Accounts
All hosting fees and fees for related services are due in advance, either yearly or quarterly as specified upon creation of the account. Overdue or unpaid accounts are subject to immediate suspension and/or termination at the discretion of GoWest Hosting.
Cancellation of Service
Sites containing any prohibited materials or fraudulent content, generating non-compliant email, causing excessive usage of system resources or found to be in violation of any terms described above, may be canceled immediately without warning and will not be eligible for any refund. GoWest Hosting reserves the right to determine what constitutes a violation of this policy. In the case of copyright infringement or other unlawful activity, suspected materials and content may be submitted to law enforcement or other regulatory agencies as applicable.
GoWest Hosting is in no way liable for any loss of business income, or perceived income as a result of the customer failing to pay balances due. In the case of active accounts, all services will cease until such time as payments are rendered in full.
Disputes or Clarification of Terms
